| Abstract: | У статті розглянуто особливості реалізації прав фізичних та юридичних осіб в умовах воєнного або надзвичайного стану. Визначено, що в період воєнного стану можуть встановлюватися окремі обмеження прав і свобод із зазначенням строку дії цих обмежень. Визначено основні засади функціонування адвокатури в умовах воєнного стану. Розкрито основні права, обов'язки та обмеження здійснення в умовах воєнного стану професійної правозахисної діяльності адвоката. |
| Description: | The article examines the peculiarities of the realization of the rights of individuals and legal entities in the conditions of military or state of emergency It has been determined that during the period of martial law, separate restrictions on rights and freedoms may be established with an indication of the period of validity of these restrictions. The basic principles of the functioning of the legal profession in the conditions of martial law have been defined. The main rights, duties and limitations of the exercise of the professional human rights activity of a lawyer in the conditions of martial law are revealed. |
