| Короткий огляд (реферат): | Стаття присвячена аналізу дозвільних процедур Національної поліції України при реалізації державної політики у сфері національної безпеки і оборони. Розглянуто думки вчених стосовно визначення дозвільної системи та дозвільної процедури. Визначено повноваження органів Національної поліції, які виконують суттєве навантаження щодо реалізації ряду повноважень з видачі дозволів на здійснення певних видів діяльності при реалізації державної політики у сфері національної безпеки і оборони. |
| Опис: | The article is devoted to the analysis of the authorization procedures of the National Police of Ukraine in the implementation of state policy in the field of national security and defense. The opinions of scientists regarding the permit system and the permit procedure were considered. The powers of the National Police bodies have been determined to carry out a significant burden in relation to the implementation of a number of powers to issue permits for the implementation of certain types of activities in the implementation of state policy in the field of national security and defense. It is suggested that instead of «state interests» and «citizen security», it is more appropriate to use the concept of «public interests», which should be understood as the needs important for a significant number of individuals and legal entities, which, in accordance with the legally established competence, are provided by the subjects of public administration. It is indicated that the final decisions, which confirm the authorization procedures of the National Police of Ukraine in the implementation of state policy in the field of national security and defense, are: permission to operate with objects removed from civilian circulation, license, standard in the field of defense of a NATO member state, certificate of compliance. The central place is occupied by the orders of the Ministry of Internal Affairs of Ukraine, which regulate the specified permit procedures. The National Police regulates the circulation of firearms and their ammunition through permit procedures. After all, just like the illegal circulation of narcotic drugs, so weapons create significant problems for the national security and defense of any country. It is claimed that permitting procedures in the specified area are mostly declarative in nature and are clearly defined in normative legal acts. It is argued that not all representatives of the National Police have authorization powers, but only those in which these powers are specified in their statutory laws. |
