| Abstract: | У статті проводиться аналіз правових основ захисту цивільного населення під час військових дій. Стаття присвячена аналізу співвідношення міжнародного гуманітарного права та прав людини, де визначається, що міжнародне гуманітарне право застосовується тільки в разі збройного конфлікту. Також розглядається роль міжнародних організацій у системі захисту цивільного населення у міжнародному гуманітарному праві. |
| Description: | The article analyzes the influence of the legal bases for the protection of the civilian population during military operations. The article is devoted to the analysis of the relationship between international humanitarian law and human rights, where it is determined that international humanitarian law applies only in the event of an armed conflict. The role of international organizations in the system of protection of the civilian population in international humanitarian law is also considered. As part of the study, the authors analyzed a number of international documents: the First Additional Protocol to the Geneva Conventions dated August 12, 1949, relating to the protection of victims of international armed conflicts, dated June 8, 1977, and the Second Additional Protocol to the Geneva Conventions dated August 12, 1949, relating to the protection of victims of armed conflicts not of an international nature, dated June 8, 1977. |
