Abstract: У статті досліджено можливості застосування медіаційних процедур у цивільному судочинстві. Національне законодавство надає широкі можливості для застосування медіації у цивільних правовідносинах. При цьому слід враховувати такі фактори, як: момент виникнення та тривалість спору, вид правовідносини, статус сторін, термін позовної давності, передбачена законом форма захисту (юрисдикційна, неюрисдикційна), встановлені законом та договором способи захисту цивільних прав.
Description: The article investigates the possibilities of using mediation processes in civil proceedings. National legislation provides ample opportunities for the application of mediation in civil law. Factors such as the time and duration of the dispute, the type of legal relationship, the status of the parties, the statute of limitations, the statutory form of protection (jurisdictional, non-jurisdictional), established by law and contract methods of protection of civil rights should be taken into account.
