| Abstract: | У статті розглянуто проблеми застосування кримінального процесуального закону відносно окремих категорій громадян України. Установлено, що особливий порядок кримінального провадження відносно окремих категорій громадян утворюють : 1) особливості здійснення повідомлення про підозру; 2) особливий порядок затримання й обрання запобіжного заходу; 3) необхідність інформування державних та інших органів чи службових осіб про застосування запобіжного заходу, ухвалення вироку. Аналіз питань дії кримінального процесуального закону за колом осіб дає підстави для формулювання таких висновків : дія закону за колом осіб - це його поширення на певні кола осіб залежно від обсягу й особливостей їх правового статусу. |
| Description: | The article deals with the problems of application of the criminal procedural law against certain categories of citizens of Ukraine. It is established that a special procedure for criminal proceedings against certain categories of citizens is formed by: 1) the peculiarities of the notification of suspicion; 2) special procedure for detention and election of a preventive measure; 3) the need to inform state and other bodies or officials about the application of a preventive measure, the adoption of a sentence. The analysis of the issues of the criminal procedural law on the circle of persons gives grounds for formulating the following conclusions: the effect of the law on the circle of persons is its extension to certain circles of persons depending on the volume and peculiarities of their legal status. |
