Abstract: У статті наводиться теоретичне дослідження правових проблем застосування в Україні європейських стандартів захисту права власності на землю. Здійснюється аналіз юридичної літератури, наукових публікацій, рішень Європейського суду з прав людини щодо захисту права власності на землю громадян. Досліджується практика українських судів по застосуванню європейських прецедентів в земельних майнових спорах. Автор досліджує особливості судових справ захисту права власності на землю приватними особами, реалізацію права громадян безперешкодно користуватися своєю власністю.
Description: In the article theoretical research of legal problems of application is given in Ukraine of the European standards of protection of the property right to the land. The analysis of legal literature, scientific publications, decisions of the European court of human rights concerning protection of the property right to the land is carried out. The practice of the Ukrainian courts on application of the European precedents in land receivership proceeding is investigated. The author investigates the peculiarities of court cases of the protection of land ownership by private individuals, the realization a citizens rights to freely use their property.
