| Abstract: | У статті визначено основні направлення правової роботи зі збереження договірної рівноваги в умовах турбулентності. Проведено аналіз, як в умовах війни, іникати цінових шокуючих коливань, які призводять до зупинки або зміни сталих домовленостей, визначено основні напрямки збереження комерційних зв’язків, дотримання мети контракту без відступлення від принципу обов’язковості зобов’язань. Проведено аналіз основних понять форс-мажору, hardship, визначено роль Принципів УНІДРУА, PECL, DCFR як спосіб поєднання принципів добросовісності, пропорційності та передбачуваності в умовах європейської інтеграції України. |
| Description: | The article defines the main directions of legal work on maintaining contractual balance in the conditions turbulence. An analysis was made of how, in the conditions of war, the occurrence of shocking price fluctuations, which lead to the suspension or change of permanent agreements, the main directions of preserving commercial ties, compliance with the purpose of the contract without deviating from the principle of binding obligations. An analysis of the main concepts of force majeure and hardship was carried out, and the role of the Principles of UNIDRUA, PECL, DCFR was determined as a way of combining the principles of good faith, proportionality and predictability in the conditions of the European integration of Ukraine. |
