| Abstract: | Початок впровадження медіаційних процедур з початку незалежності України передбачав швидке сприйняття суспільством можливості вирішувати спори різної правової природи в найкоротші строки та з більш вигідним результатом для сторін, ніж у судовому порядку. Однак, реалізація планів виявилась значно затягнутою, ніж очікувалось, оскільки стикнулась із протистоянням як з боку держави, так і з боку правничої спільноти і суспільства в цілому. В статті розглянуто основні шляхи подолання перешкод в ефективному впровадженні медіації в різних сферах суспільного життя для ефективного врегулювання спорів та конфліктних ситуацій. |
| Description: | Starting the implementation of mediation procedures from the beginning Ukraine's independence predicted a quick perception of the opportunity by the society resolve disputes of various legal nature in the shortest possible time and with the most profitable result for the parties than in court proceedings. However, the implementation of the plans was revealed much longer than expected, as it faced opposition from both sides the state, as well as from the legal community and society as a whole. The article discusses the main ways of overcoming obstacles in the effective implementation of mediation in different spheres of social life for the effective settlement of disputes and conflicts situations. |
