Анотація
У статті проведено аналіз наукових досліджень щодо особливостей організаційно-правових форм ведення господарської діяльності
у сфері аграрного виробництва з метою визначення ефективнішої форми організації діяльності із сільськогосподарського товаровиробництва для розвитку агробізнесу в Україні. Виділено три групи структурних елементів агробізнесу: малий, середній і великий агробізнес.
Досліджено позитивні й негативні моменти впровадження різних організаційно-правових форм організації агробізнесу.
Враховуючи особливості різних форм ведення господарської діяльності, авторами запропоновано виділити три основні групи ведення агробізнесу: малий (дрібний) агробізнес, середній агробізнес і великий агробізнес.
Визначено, що діяльність малого агробізнесу спрямована на вирощування сільськогосподарської продукції як для власних потреб,
так і на продаж, а також на комерційне вирощування овочів та окремих нішових культур. Недоліками малого аграрного бізнесу визначено
недостатність інформації та знань у певних сферах маркетингу, обмеження інформації щодо можливостей отримання інвестування в
дрібне виробництво, що призводить до самофінансування фермерів.
Товариства з обмеженою відповідальністю є найпоширенішою формою середнього агробізнесу. Однак складність функціонування
таких господарств зумовлена можливістю участі в товаристві іноземного суб’єкта. Визначено, що проблемними для середнього агробізнесу є обмеження щодо набуття права власності на землі сільськогосподарського призначення іноземними суб’єктами.
Визначено, що великі агропромислові підприємства є найбільш зручними й привабливими для залучення інвестицій. З метою отримання доступу до інвестицій найбільші сільськогосподарські виробники обирають холдингову структуру організації та розміщують свої
акції на світових фондових біржах.
Зроблено висновок про необхідність прийняття окремої спеціалізованої нормативної бази, яка б регулювала конкретні питання організації, функціонування та відповідальності суб’єктів господарської діяльності у сфері сільськогосподарського виробництва зокрема й
агробізнесу в цілому

The article analyzes scientific research on the peculiarities of organizational and legal forms of conducting economic activity in the field of
agricultural production in order to determine a more effective form of organization of agricultural commodity production for the development of
agricultural business in Ukraine. There are three groups of structural elements of agricultural business: small, medium and large agricultural business.
Positive and negative aspects of implementation of various organizational and legal forms of agricultural business organization are highlighted.
Taking into account the peculiarities of different forms of economic activity, the authors propose to distinguish three main groups of agricultural
business: small (small) agricultural business, medium agricultural business and large agricultural business.
It is determined that the activity of small agricultural business is aimed at growing agricultural products both for their own needs and for sale,
as well as for commercial cultivation of vegetables and individual niche crops. The disadvantages of small-scale agrarian business are the lack
of information and knowledge in certain areas of marketing, the limitation of information on the possibilities of obtaining investment in small-scale
production, which leads to self-financing of farmers.
Limited liability companies are the most common form of medium-sized agribusiness. However, the complexity of the operation of such farms
is conditioned by the ability to participate in the partnership of a foreign entity. It is determined that restrictions on the acquisition of ownership of
agricultural land by foreign entities are difficult for the average agricultural business.
It is determined that large agricultural business is the most convenient and attractive for attracting investments. In order to gain access to
investment, the largest agricultural producers choose the holding structure of the organization and place their shares on world stock exchanges.
The conclusion was made about the necessity of adopting a separate specialized regulatory framework, which would regulate specific issues of
organization, functioning and responsibility of economic entities in the field of agricultural production in particular, and agricultural business in general.
